Dismissal of Drug and Gun Charges
We have had a great couple of weeks at Jennifer M. Daniels, P.C. with success in two criminal cases. The first involved drug and weapons charges in Walton County. The client, who had a criminal history, was charged with Possession of a Firearm by a Convicted Felon, Violation of the Georgia Controlled Substances Act and Crossing the Guard Line with Contraband. The prosecutor originally recommended a sentence of 20 years to serve 6 years in custody if the client pled guilty to the charges. We obtained the discovery in the case and filed a detailed Motion to Suppress the Evidence. The day before the hearing was to take place, the prosecutor agreed to dismiss all the charges based on that Motion to Suppress. Our client no longer faces criminal prosecution.
Straight Probation in Difficult Case
Second, we represented a woman charged in a RICO case in Fulton County. She had gotten involved in a scheme to use other persons identifying information to file false state tax returns than netted over $150,000.00 for the perpetrators. The client came from a great family and worked diligently during her time out on bond to better herself. She obtained certification in the medical field and got a job immediately following completion of the program. She remained out of trouble and did what was necessary to help investigators in the case. Despite her cooperation, the Attorney General’s Office was still recommending that she serve two years in prison for her involvement in the scheme. With hard work and persuasion, we were able to convince the judge to give her straight probation with no jail time.
