IF I’VE BEEN INJURED IN AN ACCIDENT DO I HAVE TO PAY A LAWYER TO HELP ME?

The answer, 99% of the time is: no. Whether you will receive money, and, more importantly, how much money you will get as a result of an injury (or death of a loved one) depends on the quality of the lawyer you hire to help you. Lawyers like me work on what’s called a contingency-fee basis. That means we work hard to get a great result (i.e. money) for you and then we take a percentage of the total award for the work we’ve done. You, as the client, almost never have to pay for the costs of bringing a lawsuit against the offending party and, trust me those costs can be quite high.

Depositions, medical records and expert witnesses all cost money (sometimes a great deal of money) to procure and I, as your lawyer, pay those costs up front. No money comes out of your pocket. At the end of the case (when we either settle or the other side pays the verdict a jury has rendered against them), I deduct from the total award all the fees incurred as well as my fee for my services in getting the great result we achieved. The percentage for most attorneys’ fees ranges from one-third (33.33%) of the total awarded up to 50%. I, personally, have never charged a fee of 50% of an award, but I know some lawyers do.

 NEED TO HIRE A TRIAL LAWYER WHEN YOU’VE BEEN HURT

For some of you, a one-third or higher percentage of recovery may seem high. But consider this: insurance companies (the true opposing party in most cases) do their dead-level best to not pay anything. It takes a great deal of skill, knowledge and expertise to get them to pay the money that you deserve. You will never achieve this on your own. Hiring a mill lawyer (one who takes in hundreds of cases a year with the goal of settling them as quickly as possible) may result in getting your case settled but often at a significant discount because the insurance company knows the lawyers won’t ever take the case to trial where a jury can return a substantial verdict on your behalf. Trial lawyers like me essentially gamble our own money on our ability to achieve a great result for you by agreeing to foot the bill for the expenses of bringing a case.
