Drug Trafficking in Georgia

Trafficking in drugs occurs when a person possesses, sells, purchases or manufactures controlled substances in excess of a certain weight as set forth by statute. Some drugs require a great deal more weight to reach trafficking amounts than others. For example, trafficking in marijuana requires a minimum weight of 10 pounds (previously it was 50 pounds, which we can all agree is a lot of pot) yet trafficking in heroin only requires a minimum possession of 4 grams.

 Trafficking in Cocaine, Methamphetamine, or Heroin 

Georgia’s trafficking statutes (found at O.C.G.A. §16-13-31) are tier-based, meaning that the minimum sentence required by law will depend on the amount of the drug involved. The statutes controlling trafficking in cocaine and methamphetamine, for example, have three tiers: (1) possession of more than 28 grams but less than 200 grams carries a minimum 10 year sentence; (2) possession of more than 200 grams but less than 400 grams carries a minimum 15 year sentence; and (3) possession of more than 400 grams carries a minimum of 25 years in prison. The statutes controlling trafficking in heroin also has three tiers, which are as follows: (1) possession of more than 4 grams but less than 14 grams carries a minimum 5 year sentence; (2) possession of more than 14 grams but less than 28 grams carries a minimum 10 year sentence; and (3) possession of more than 28 grams carries a minimum of 25 years in prison.

Trafficking in Marijuana

Marijuana is treated in terms of pounds and the statutory trafficking tiers are as follows: (1) possession of more than 10 pounds but less than 2000 pounds carries a minimum 5 year sentence; (2) possession of more than 2000 pounds but less than 10,000 pounds carries a minimum 7 year sentence; and (3) possession of more than 10,000 pounds carries a minimum of 15 years in prison.
